By accessing and using We Had a Baby, What Now? ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

We Had a Baby, What Now? provides weekly meal planning services designed for busy families, particularly those with toddlers (12-36 months). Our service includes:

  • 6 different meal plan templates (Omnivore, Vegetarian, Pescatarian, Gluten-Free, Vegan, No Red Meat)
  • Weekly meal plans with family-friendly recipes
  • Shopping lists organized by grocery store aisles
  • Prep guides and cooking instructions
  • Toddler-specific adaptations and safety guidelines
  • PDF downloads for offline use

3. Subscription and Payment

Our service operates on a subscription basis with the following terms:

  • Free Trial: 7-day free trial for new subscribers
  • Monthly Plan: $9.99 per month, billed monthly
  • Annual Plan: $79.99 per year, billed annually (33% savings)
  • Billing: Automatic renewal unless cancelled
  • Cancellation: Cancel anytime through your dashboard
  • Refunds: No refunds for partial months or years, but you retain access until the end of your billing period

4. User Account and Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and complete information during registration
  • Updating your account information to keep it current
  • Using the service in compliance with all applicable laws

5. Content and Intellectual Property

All meal plans, recipes, content, and materials provided through our service are owned by We Had a Baby, What Now? and are protected by copyright and other intellectual property laws. You may:

  • Use the content for personal, non-commercial purposes
  • Print meal plans and shopping lists for your family's use
  • Share individual recipes with friends and family with attribution

You may not:

  • Reproduce, distribute, or sell our meal plans commercially
  • Create derivative works based on our content
  • Share your account credentials with others

6. Health and Safety Disclaimer

Important: Our meal plans and recipes are for informational purposes only and are not intended as medical or nutritional advice. We follow FDA mercury guidelines and CDC choking prevention recommendations, but you should:

  • Consult with your pediatrician before introducing new foods to toddlers
  • Always supervise young children during meals
  • Modify recipes based on your child's specific needs and allergies
  • Use your judgment regarding age-appropriate foods and preparations

7. Disclaimer of Warranties and Limitation of Liability

DISCLAIMER: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

FOOD SAFETY DISCLAIMER: YOU ACKNOWLEDGE THAT:

  • All recipes and meal plans are suggestions only
  • You are solely responsible for food safety, proper cooking temperatures, and freshness
  • We are not liable for any food-related illness, allergic reactions, or choking incidents
  • You must use your own judgment regarding food allergies and dietary restrictions
  • Always supervise young children during meals and modify recipes as needed

LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

10. Indemnification

You agree to indemnify, defend, and hold harmless We Had a Baby, What Now?, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) any food-related incidents resulting from your use of our recipes or meal plans.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in Delaware. You agree to resolve disputes through binding arbitration, except for claims involving intellectual property or injunctive relief.
